These Terms & Conditions apply to the use of this website and, where applicable, to quotations, orders and the supply of goods and services by Ensign.
By using this website, requesting a quotation or placing an order with Ensign, you agree to the terms applicable to that activity.
WEBSITE USE
The information provided on this website is for general information purposes and may be changed without notice. Ensign takes reasonable care in preparing website content but does not warrant that all information will at all times be complete, current or free from error. Product photographs, colours, illustrations and examples are intended as guides only. Appearance may vary according to materials, manufacturing processes, screen reproduction and other factors. You are responsible for determining whether the information, products and services described on this website are suitable for your requirements.
INTELLECTUAL PROPERTY
Unless otherwise stated, the content of this website, including its design, text, graphics, photographs and other materials, is owned by or licensed to Ensign. Content must not be reproduced, distributed or used commercially without permission, except where permitted by law. Trademarks, logos, crests and other intellectual property belonging to customers or third parties remain the property of their respective owners.
QUOTATIONS
Quotations are based on the product specifications, quantities, artwork, manufacturing requirements and other information available to Ensign at the time the quotation is prepared. Changes to quantities, materials, design, specifications, packaging, delivery requirements or other project requirements may require a revised quotation. Unless otherwise stated in writing, a quotation does not constitute acceptance of an order.
CUSTOM PRODUCTS & ARTWORK
Customers are responsible for ensuring they have permission to reproduce any logo, trademark, crest, artwork, photograph or other material supplied to Ensign. Ensign may adapt supplied artwork where necessary for manufacturing, weaving, printing, embroidery, engraving or other production methods. Where artwork, specifications, proofs or samples are submitted for approval, the customer is responsible for checking them carefully before approval. Production may proceed once final approval has been received.
SAMPLES & PRODUCTION
Samples or pre-production proofs may be supplied where applicable. Samples may differ slightly from final production because of normal variations in materials, colours and manufacturing processes. Production times are estimates unless Ensign expressly agrees otherwise in writing. Timing can vary according to product, quantity, sampling requirements, manufacturing method, freight and circumstances outside Ensign's reasonable control.
QUANTITIES
Minimum order quantities may apply to customised products. Where manufacturing processes make exact quantities impractical, reasonable production variations may occur. Any applicable quantity tolerance will be advised as part of the quotation or order process where relevant.
PAYMENT & ACCOUNT TERMS
New customers are supplied on a Cash on Delivery (COD) basis by default unless alternative trading terms have been approved by Ensign. Approved trading accounts may be offered on 14-day or 30-day payment terms. Where an account has been approved for 14-day or 30-day terms, payment must be received within the applicable period stated on the invoice. Late fees may apply to overdue accounts in accordance with the applicable invoice or account trading terms. Ensign may suspend further production, orders, deliveries or account facilities where an account is overdue. Prices and any additional payment requirements will be stated in the relevant quotation, invoice or approved account terms. Ensign may require full payment or a deposit before artwork development, sampling, production or dispatch.
DISTRIBUTOR ACCOUNTS
Distributor accounts are available by application and are subject to approval. Distributor customers may be supplied on COD, 14-day or 30-day terms according to the account arrangements approved by Ensign. Account trading terms apply to all approved distributor accounts.
CHANGES & CANCELLATIONS
Custom products are manufactured specifically to customer requirements. Once artwork, sampling or production has commenced, changes or cancellation may result in costs already incurred becoming payable. Orders that have entered production may not be capable of cancellation. Any cancellation or alteration should therefore be requested as soon as possible and will be considered according to the stage reached by the order.
DELIVERY
Delivery dates are estimates unless otherwise expressly agreed in writing. Ensign is not responsible for delays caused by carriers, customs, manufacturers, industrial action, weather, supply disruptions or other circumstances beyond our reasonable control. Freight, delivery and special packaging charges may apply as stated in the quotation or invoice.
PROBLEMS WITH YOUR ORDER
Customers should inspect goods after delivery and notify Ensign promptly if there is a problem with the quantity, manufacture or specification of an order. We will assess reported issues and, where appropriate, work with the customer to determine a suitable remedy. Nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under applicable Australian law, including the Australian Consumer Law where it applies.

LIABILITY
To the extent permitted by law, Ensign excludes liability for loss arising solely from reliance on general information published on this website. Nothing in these Terms & Conditions is intended to exclude liability or statutory rights that cannot legally be excluded.
GOVERNING LAW
These Terms & Conditions are governed by the laws applicable in New South Wales, Australia.
